NextGen — Website Terms of Service

  1. Agreement to Terms By accessing or using nextgen.com.au (the “Site”) and purchasing products or services from NextGen (“we”, “us”, “our”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site or purchase products.

  2. Who We Are NextGen is a Sydney, Australia-based provider of templates, jigs and small tools for electricians. Our contact email: support@nextgen.com.au.

  3. Products and Orders a. Product descriptions on the Site are subject to change. We make reasonable efforts to display accurate colours, measurements and specifications but cannot guarantee exact matches to on-screen images.
    b. All orders are subject to availability. We may accept or reject orders at our discretion. You will receive confirmation when we accept your order.

  4. Pricing and Payment a. Prices are shown in AUD and exclude shipping unless otherwise stated. We reserve the right to correct pricing or typographical errors.
    b. Payment is taken at the time of order using the payment methods displayed on the Site. You warrant that you are authorised to use the chosen payment method.

  5. Shipping and Delivery a. Shipping times are estimates only. We are not liable for delays caused by carriers or circumstances beyond our control.
    b. Risk passes to you on delivery. You must inspect items on receipt and notify us promptly of damage or non-delivery.

  6. No-Refund / Returns Our No-Refund Policy applies to purchases; see the No-Refund Policy posted on the Site. Nothing in that policy affects your statutory rights under the Australian Consumer Law.

  7. Warranty and Liability a. We warrant products for defects consistent with the product description and applicable consumer guarantees under Australian Consumer Law. Claims for faulty goods must be made promptly with evidence (photos, order number).
    b. To the fullest extent permitted by law, our liability for loss or damage is limited to the purchase price of the relevant product. We are not liable for indirect, special or consequential losses.

  8. Intellectual Property All Site content, trademarks, logos, images and materials are our property or licensed to us. You may view and print pages for personal, non-commercial use only. You must not reproduce, modify, distribute or create derivative works without our written permission.

  9. Account Use and User Conduct a. If you create an account, you are responsible for maintaining its confidentiality and all activity that occurs under it. Notify us immediately of unauthorised use.
    b. You must not misuse the Site, upload harmful content, infringe third-party rights, or use the Site for unlawful purposes.

  10. Privacy We collect and use personal information in accordance with our Privacy Policy. By using the Site, you consent to that collection and use.

  11. Termination We may suspend or terminate access to the Site or cancel orders at our discretion (including for breach of these Terms). Termination does not affect rights that have accrued prior to termination.

  12. Changes to Terms and Products We may amend these Terms, product listings, prices and policies at any time. Changes take effect when posted on the Site. Your continued use after changes constitutes acceptance.

  13. Governing Law and Dispute Resolution These Terms are governed by the laws of New South Wales, Australia. Where possible, parties agree to attempt to resolve disputes by negotiation or mediation before commencing legal proceedings.

  14. Severability If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in full force.
